This website www.urbanbiophilic.co.uk is run by Arti Green Ltd. The the terms “we”, “our” and “us” refers to Arti Green Ltd trading as Urban Biophilic. Please read these Terms and Conditions carefully.

By accessing this website, you agree to adhere and be bound by these Terms and conditions. If you do not agree to all of the terms and conditions of this agreement, then you may not access the website or use any of it's services. If these Terms of trading are considered an offer, acceptance is expressly limited to these Terms.We reserve the right to update, change any of the Terms listed below. It is your responsibility to check this page periodically for changes. Your continued use of or this website following any changes to these Terms will constitute acceptance of such changes.

1) OrderingGoods & Pricing: Our aim is to supply high quality products sourced reputable suppliers and growers throughout Europe. The description of the goods, available quantity, quality, price and delivery costs are outlined on this website. Prices include VAT at the current rate. Our VAT registration number is 290341124 (Arti Green Ltd T/A Urban Biophilic.

1.2) Illustrations, photographs, product descriptions and other information relating to certain goods excluding the price, VAT and delivery costs are indicative only and serve only as a guideline. For example, live plant products may change / grow whilst in stock / in our care. Therefore the item you receive may look slightly different from the product image shown. Please note - Some of the plant pots we supply are not 100% waterproof and we therefore recommend the use of a liner to protect the pots and prevent damage to floors and surfaces such as worktops and shelves. Arti Green Ltd T/A Urban Biophilic is not legally bound by obvious errors or mistakes in the offer and/or the agreement. 

1.3) Prices are subject to change without notice. 

1.4) We shall not be liable to you or to any third-party for any price change, suspension or discontinuance of products or services.

1.5) We reserve the right to refuse to accept an order at our discretion. If for any reason we do not accept your order, your payment will be automatically refunded to the card you originally made your initial payment with.

2) Payment: We will take payment upon receipt of your order. We accept no liability if delivery of the goods is delayed by the supply of incorrect payment details. If we do not receive full payment for the goods when the order is placed, we reserve the right to cancel the contract and goods will not be delivered. Where payment is outstanding, the goods remain the property of Arti Green Ltd and title will not transfer until payment has been received in full. By ordering from our website you are giving us your consent to pass essential information to complete your purchase of goods to our card payment service provider.

2.1) Orders will not be processed, packed or shipped until payment is received. 

2.2) We reserve the right to cancel and refuse any order that our payment service provider flags as potentially fraudulent. 

3) Delivery / Shipping:  We only ship within the UK. We pack and ship orders on Mondays, Tuesdays, Wednesdays and Thursdays. We don't ship on a Friday as the plants will sit in a courier depot or in transit for an unnecessary length of time. 

3.1)  We aim to dispatch all orders placed by you within 1-3 days and in any event no later than 30 days from placing your order, unless we contact you to state otherwise. Plants are living and unless treated correctly, can perish. If certain conditions are not suitable for transportation, we reserve the right to delay delivery until conditions are suitable.

3.2) We shall not be required to fulfil orders for goods in the sequence in which they have been placed. We are not required to deliver orders in instalments and reserve the right to only deliver an order if all of the goods on the order are available for dispatch. Unless otherwise agreed, goods ordered together will be shipped together when all goods are available. 

3.3) We can only deliver to the address you have entered at the time of ordering. We cannot change a delivery address thereafter, once the order has been placed. It is your responsibility to ensure the correct delivery address is entered at the time of placing the order. We will not liable for orders that are returned to us by the courier as 'unable to deliver' due to incorrect or incomplete address details or post code.

3.4) Ownership and Risk: Plants are live perishable goods and you 'the customer' are responsible for the care and maintenance of the goods once delivered. Risk of damage to or loss of the goods will be your responsibility from the time we deliver to, or first attempt to deliver the goods, to the delivery address you provided and whether or not a signature of receipt has been obtained by the delivery courier.

3.5)We aim to supply plants of a high quality and in excellent condition. If you feel damage has occurred during transit and has arrived to you with clear visible damage to the outer packaging, please inform us within 24hrs and provide photographic evidence showing the damage to the item and packaging with the delivery label clearly shown. Courier damage can occur every once in a while and this evidence helps us make a case with the courier.

4) Cancellation & Returns: You have the right to cancel your Order up to 72 hours ahead of your scheduled delivery time. If you exercise this right then you will receive a full refund of the cost of the products ordered and the costs of delivery. If you opt to cancel your order after this point, but before the delivery of products, you will receive a refund of the cost of the products ordered, but not for the costs of the scheduled delivery. 

4.1) We reserve the right to cancel the contract of sale if we have insufficient stock to deliver the goods you have ordered; we do not offer delivery to your location; payment is not received in full; or goods you ordered were listed in error or with an incorrect price.

4.2)Once goods have been shipped, we are unable to cancel shipment of your order. If you have changed your mind you can return planters and pots to us within 7 days at your cost. Under the Consumer Contracts Regulations 2014, we do not accept returns of perishable goods including plants and flowers unless they arrive to you faulty or damaged, in which case you must inform us within 24 hours of delivery.

4.3)We will refund the cost of the goods in full, provided that they are in no worse condition on return to us than at the time of delivery. Unfortunately, we are not able to refund the cost of delivery in this situation. Dried out or damaged plants will not be accepted and we reserve the right to refuse a refund of returned items if they are not received in good order for re sale.

4.4)Within 7 days after receipt of Products, you have the right to return your items at your own cost or if the goods are faulty or damaged, we will arrange a collection. We will then issue a refund of the cost of the Products delivered. If we collect the products and goods are not deemed to be damaged or faulty, you will, be subject to a collection charge.

4.5)After 7 days from the day of delivery (or first attempted delivery) you have expressed your satisfaction with the plants, you recognise they are perishable and that we have no control over the conditions in which you choose to plant or maintain them. You are responsible for their care and we will have no further liability in respect of the plants for any failure to establish or thrive whilst in your care.

4.6)Please return the goods to us in their original packaging, quoting the order reference number. We advise that you return any goods using registered post in order to ensure their safe return. We will not be liable for any returned goods that we do not receive in good condition.

4.7)Planters and pots should be packaged to protect against breakage as we cannot refund items that arrive damaged. Please note, for larger pots that also have individual, lightweight product packaging, these boxes are not suitable for protection during shipping. Please use a double wall outer box and wrap the pots in heavy duty bubble wrap and or stiff cushioning paper to cushion. You will need to brace the pots against any movement in the box.

4.8)The legal right to cancel orders because you have changed your mind does not apply to perishable goods including plants (see above for our plant policy); made to order items; or goods which have been used.
